Austin, TX, May 15, 2012 - The District Court Judge Stephen Yelenosky Texas yesterday issued a letter announcing his decision to withdraw permission of pollution that would have authorized the construction of the Energy Center of Las Brisas in Corpus Christi, TX. Permission had authorized the massive mono & diglycerides emission of pollutants that have particularly affected schools mono & diglycerides and nearby, mostly black and Hispanic neighborhoods. The Sierra Club, the Environmental Defense Fund (EDF), the local Coalition for a Clean Economy and an alliance of cities in Texas joined forces in 2009 to withdraw authorization for plant contamination, arguing that the Commission on Environmental Quality (TCEQ) drained the record and did not comply with various mono & diglycerides requirements of the Clean Air Act. The attorney for the Environmental Integrity Project Erin Fonken, representing the Sierra Club in the lawsuit, said, "The court has announced that it intends to rule against the TCEQ because, in issuing the permit, the commission made several crucial legal errors. These include failing to require the new plant meet standards to protect the Clean Air Act nor did due account of the millions of tons of petroleum coke which had been stored at the plant to be burned in the boiler main installation ". The announcement of the court is the latest in a long list of defeats suffered by the drivers of the plant, which, had it been built, had issued some 12 million tons of global warming gases a year, like thousands tonnes of hazardous pollutants that contribute to smog formation, which triggers asthma attacks and causes heart disease. The Environmental Protection Agency is currently considering a separate permit application to authorize the issue of global warming gases, and the permit must be approved before the plant is built. The future of the proposed Las Brisas is now in doubt. mono & diglycerides The plant, originally proposed in 2008, no building permits under the Clean Air Act. The installation is facing strong opposition by local groups, including local authorities, business leaders and residents of surrounding communities Corpus Christi already suffering the legacy of dozens of polluting facilities in that area. "The proposed Las Brisas remains the wrong answer to the needs of Corpus Christi," said Flavia de la Fuente of the Sierra Club. "The city is striving to become more livable and sustainable. The proposals to tie Corpus Christi even more dirty industries of coal and petroleum coke as Las Brisas and other projects, lead us down the wrong path. The court decision is great news for leaders and residents who are working hard to improve the future of Corpus Christi and its residents. " "This is a real victory for our community," said Danny Lucio, project manager for the Coastal Bend Bays Foundation, one of the groups opposed to Las Brisas. "From the beginning we knew that this would be a disaster for our city, especially mono & diglycerides in the poorest areas, mono & diglycerides where many families face a daily barrage of pollution from existing facilities. mono & diglycerides Although the legal process is taking so long, we are grateful for the judge's decision and we can finally breathe much calmer. "
